Legally purchased hard copies of materials in most formats may be placed on reserve for any duration required by the instructor. This includes both instructors' personal copies of materials and library copies of books or AV materials, including textbooks. In accordance with the Interlibrary Loan Code, Dacus Library will not place books or other materials obtained via Interlibrary Loan (or PASCAL Delivers) on Course Reserve.
All excerpts from books and journals, whether in hard copy or electronic format, will be evaluated for copyright compliance. Electronic Reserves are now part of the Blackboard Content Collection. The library's reserves staff will scan or link to requested readings and place files and links in Blackboard's eReserves content folders, providing for easy integration with other course materials. Reserves staff will complete a Fair Use analysis of each request; however, the library has a limited budget for licensing fees, so instructors are encouraged to select articles from the library's subscription databases whenever possible, or to keep readings within the parameters of "Fair Use." The reserves staff evaluates each submission individually; there is no single standard for amount or content that applies to all situations. The commonly applied minimum standards for Fair Use are:
No more than 3 hard copies of an article or chapter from a book
1 article from an issue of a journal, or one chapter from a book
These standards can be applied to both electronic and physical copies of excerpted readings. Please note that these recommendations do not carry the force of law; they do not preclude other, more extensive uses which may also be "fair," nor do these parameters guarantee that a use does not constitute infringement.
All electronic readings must be removed from reserve at the end of each semester. Requests to re-post are evaluated on a case-by-case basis, and in some cases may require the permission of the rightsholder and/or payment of licensing fees.
